


Once you have read and understood the agreement below, please click the "Agree" button and proceed to the application form.
1) Technical Support (Mobile Broadband Rental)
Trouble may arise when you try to install or run Mobile Broadband Rental software. This may result from the networking or firewall security settings at your company, or from the settings or software in Customer’s computer. If this happens, please contact the system administrator or vendor. Incompatibilities that may arise between the Customer’s computer settings and MTREND’s Mobile Broadband Rentals are not covered by MTREND’s customer support service.
2) Scope of contract
The duration of this agreement is for the rental period specified in the
Global Phone Servie Online Application Form ("Cellular Phone Rental Agreement"). Extensions are possible only when the contractor (or signatory if signed by a corporation) submits an application for an extension prior to the termination of the Cellular Phone Rental Agreement. Rental fees paid at the time of application are not refundable in cases where rental phones are returned before the termination of the rental period. Any delays in returning equipment without prior notification will be processed as lost or stolen and service will be suspended. You will be charged for the rental fees and charges for all calls made during the contract period including the period lasting until the service is suspended.
b. Monthly Plan
Depending on the plan you select, the duration of this agreement is one or two years from the date specified in the
Global Phone Servie Online Application Form. In the event Customer cancels service before the contract end date, Customer will be charged for the remainder of the contract term. After the one or two year period, the contract will take effect on a month to month basis. The monthly charge for the month of cancellation will be pro-rated.
3) Airtime charges
Depending on the country being visited there may be airtime charges for incoming calls. There will be charges for calls made to toll-free numbers and for calls made via calling card. You will be billed for all other chargeable calls made from the rental cellular phone including, but not limited to, collect calls and call forwarding. Please note that for long term rentals, MTREND will monitor the Customer’ usage and charge accordingly. Therefore, there may be cases where Customer is charged more than once in a given month.
4) Lost, Stolen, or Damaged
a. (Global Phone Rental)
If the rental cellular phone and/or accessories has be lost or stolen, or has sustained heavy damage (total loss) , please report it to MTREND immediately and within regular business hours. If the cellular phone and/or accessories have been lost or stolen, Customer will be charged their actual retail costs unless Customer has purchased insurance coverage, in which case Customer will be charged no more than $50. If the rental cellular phone and/or accessories are damaged, Customer will be charged for the cost of repairs unless Customer has purchased insurance coverage. Customer will be charged the normal rental and usage fees until a lost, stolen, or damaged report has been made.
b. (Mobile Broadband Rental)
If the rental Mobile Broadband Rental and/or accessories have been lost or stolen, or has sustained heavy damage (total loss), please report it to us immediately and within our regular business hours. If the Mobile Broadband Rental has been lost or stolen, Customer will be charged for the full retail cost of the device. If damaged, Customer will be charged for the cost of repairs. Customer will be charged the normal rental and usage fees until a lost, stolen, or damaged report has been made.
5) Payment Guarantee
Customer must agree to the “Payment Guarantee” which requires a $200 credit card authorization hold. This is required irrespective of whether payment will be made by check or credit card. All outstanding payments and unpaid obligations (including costs derived from the device being lost, stolen, or damaged) will be charged to this account. The Payment Guarantee also requires that if payment is not received by its due date and if the credit card cannot be otherwise be used for settlement, Customer pay late fees at the rate of 12% (annual compounding) plus related costs (such as attorney's fees, etc.). Payment must be received within 14 days from dispatch of payment requests.
If Customer is a corporation, a representative of the corporation must, in their individual capacity, also agree to the Payment Guarantee. If the actual user is an individual or entity other than the Customer, the actual user must also agree to the Payment Guarantee. Customer shall be held primarily responsible however, all parties agreeing to the Payment Guarantee will be held jointly and severally liable for all monies due pursuant to the above paragraph.
In the event that all outstanding payments and unpaid obligations cannot be settled by the due date, service may be suspended and there will be a fee charged for reactivation.
6) Scope of Liability
(Please read the following statements carefully.)
a. MTREND does not assume any liability for problems or damage caused by the use of MTREND’s services and products.
b. In some limited areas, Customer may be unable, or partially unable, to use MTREND’s service due to interference. Even in service areas, there may be limitations/interruption of service due to regional situations such as, but without limitation to, strikes, government actions, or other causes beyond MTREND’s control. In such a case, MTREND may not be able to restore service and/or provide a refund.
c. Service may be vulnerable to monitoring.
d. Due to the sensitive nature communication devices, cellular phones may at times unexpectedly malfunction.
e. If Customer does not receive the equipment by the designated date, please notify MTREND immediately as Customer may still be liable for rental fees. If Customer did not receive rental cellular equipment by the rental commencement date due to Customer’s circumstances, there shall be no refund rental fees. In addition, please use our prepared waybill for return shipment as shipping and handling charges apply even if Customer makes their own return shipment arrangements.
7) Cancellation
A cancelation fee ($18 per unit + shipping charge) will be applied should Customer cancel their reservation on or after the date of shipment.
8) Special Restrictions
Customer’s assigned cellular phone number is temporary and Customer should treat it as such. Please observe all local restrictions on cellular phone use such as, but not limited to, on flights or in hospitals.
Changes to the rental cellular phone settings beyond the scope of the user manual are prohibited. The listing of rental cellular phone numbers in printed materials available to the public is also prohibited.
9) Jurisdiction
All actions or proceedings arising in connection with this agreement shall be tried and litigated exclusively in the New York Supreme Court.
